Vulneración de seguridad de los datos personales

Una vulneración a la seguridad de los datos personales abarca cualquier incidente que comprometa la confidencialidad, disponibilidad o integridad de la información. En HEKA diseñamos estrategias para implementar un enfoque preventivo y reactivo, concientizando a los empleados y evaluando riesgos legales, organizativos y técnicos para asegurar el cumplimiento de normativas y buenas prácticas.

La Ley Orgánica de Protección de Datos Personales y su Reglamento, ha establecido como obligación adicional, en casos de brechas, notificar a las autoridades competentes y al titular de los datos personales en los casos en los que exista una inminente vulneración a los derechos y libertades de estos últimos.

A pesar de la falta de una Autoridad de Control, es importante contar con una plataforma interna de cumplimiento, así la empresa podrá establecer políticas, procedimientos y controles que fortalezcan su postura en materia de protección de datos.

¿Qué Constituye una Vulneración de la Seguridad de Datos Personales?

  1. 🗑️ Destrucción o imposibilidad de acceso a los datos por parte del responsable.
  2. 🔄 Alteración o corrupción de los datos
  3. 🤷‍♂️ Pérdida de control o acceso a los datos
  4. 🚫 Tratamiento no autorizado o ilícito

 

¿Qué hacer ante una Vulneración?

En caso de existir una vulneración de seguridad de los datos personales, la empresa debe:

  1. 🌐 Identificar el origen, el alcance, los sistemas vulnerados, los datos y categorías de titulares afectados
  2. 🕵️ Activar el cumplimiento de políticas a fin de contener y mitigar riesgos asociados
  3. 💻 Efectuar evaluaciones del impacto de las brechas de seguridad en los derechos de los titulares afectados
  4. 🕵️‍♂️ Analizar el riesgo que implica para la compañía tanto en aspecto económico como operativo y reputacional
  5. 📉 Notificar, en los términos de la LOPDP y su Reglamento, a la Superintendencia de protección de Datos, ARCOTEL y al titular
  6. 📋 Llevar un registro de los incidentes procurando la resiliencia y mejora continua
