Frequently Asked Questions

Common questions in tax matters

What is the difference between tax planning and tax avoidance?+

Tax planning organizes a company's operations within the current legal framework to optimize its tax burden, while avoidance seeks to circumvent the law through artificial arrangements. Our work is always confined to lawful structures that are sustainable over time.

What should I do if the SRI opens a tax assessment proceeding against my company?+

It is essential to review the requirement in a timely manner, gather the corresponding supporting documentation and file your response within the legal deadlines. We support this process from the initial response through to any eventual challenge of the administrative act.

What is transfer pricing and who does it apply to?+

Transfer pricing refers to the terms agreed upon in transactions between related parties. Regulations require that these transactions reflect market conditions, which obliges companies with economic ties to maintain technical studies supporting their pricing before the SRI.

Does HEKA represent companies in tax judicial proceedings?+

Yes. When the administrative avenue is exhausted without a favorable outcome, we take on representation before the Tax Court and, if necessary, in the corresponding cassation proceedings.
