What regulations should I know to properly manage my educational institution?+
The day-to-day management of an educational institution requires knowing and keeping up to date with the obligations set out in the CLOEI, the RGLOEI and the applicable Ministerial Agreements, making it possible to promptly identify requirements, procedures, responsibilities and risks of non-compliance.
What do I need to obtain an operating permit from the MINEDEC?+
A complete file is required: Pedagogical proposal; Risk Management Plan, Title of ownership or document evidencing use of the property; Sworn Statement, Proposed name, Economic-Financial study.
When must I update my registrations or permits?+
When there is an expansion of the service, a change in the school system, an expansion of the modality, an expansion or change of the school day, an expansion of the population served by the educational offering, a change of the educational promoter and/or legal representative, or a change of the institution's name.
How should my institution handle student data under the LOPDP?+
Institutions process sensitive data belonging to minors, so they need clear legal bases for processing, privacy notices, data-processing agreements with vendors, and security protocols. We design a compliance model tailored to the education sector and train your team.
What do we do if the District initiates an administrative proceeding against the institution?+
We provide support and defense throughout the entire administrative sanctioning procedure, from the response and the filing of objections and evidence, through the hearing and resolution, verifying compliance with due process under the RGLOEI, the CLOEI and the Ministerial Agreements applicable to private educational institutions.
If necessary, the defense can be escalated to constitutional or judicial venues, with the aim of protecting the institution's rights and its operational continuity.
What sanctions can an educational institution face?+
The consequences of non-compliance can be significant. The CLOEI provides for fines ranging from 1 to 50 unified basic salaries —USD 482 to USD 24,100— and, in certain cases, even the revocation of the operating authorization. Proper preventive management and timely defense help reduce contingencies and protect the institution's continuity.
