The first
New Space Law
practice in Ecuador.

HEKA Attorneys launches the first specialized New Space Law practice in Ecuador: a comprehensive, multidisciplinary and fully dedicated service designed to connect the global space economy with the country’s and the region’s legal and business reality.

Ecuador holds unique conditions (equatorial location, developing technical capabilities and projects such as its first spaceport), yet still lacks a national space law. This turns the sector into a strategic opportunity that is currently being built.

In this context, HEKA advises companies, investors and institutions on regulation, investment, contracting and structuring, with a practical approach aligned to international standards.

More than advising, we participate in building the legal framework of Ecuador’s space sector.

Four pillars.
One team.

Every space project demands simultaneous expertise across multiple disciplines. Our practice is structured around four integrated pillars that work in a coordinated manner.

Navigating the multilevel regulatory environment of the space industry, at national and international scale, requires deep expertise across diverse jurisdictions and institutions.

  • National and international regulatory framework on space matters: includes regulations issued by ARCOTEL and the International Telecommunication Union (ITU), as well as the main treaties, principles and international agreements applicable to the use and exploration of outer space, including the Artemis Accords and UN space treaties
  • Licenses for satellite operations and launch activities
  • Allocation and protection of orbital positions and radio spectrum
  • Regulation of suborbital flights and space tourism
  • Orbital sustainability and space debris compliance
  • Representation before national and international regulatory bodies

Space projects require sophisticated legal and financial architecture. We structure the vehicles, negotiate the terms and secure the approvals that make space investment viable.

  • Structuring of SPVs, joint ventures and consortia for space projects
  • Advisory on foreign direct investment in the Ecuadorian space sector
  • State investment contracts and PPPs for space infrastructure (spaceports, ground stations)
  • National and international tax planning for space structures
  • Project finance, M&A and satellite sector transactions
  • International and cross-border vehicle structuring
  • International arbitration and dispute resolution in the space sector

Every space project is supported by contracts. We draft, negotiate and structure agreements that withstand the operational realities and legal complexities of the space industry.

  • Launch and satellite acquisition contracts
  • Satellite capacity contracts, transponder leasing and connectivity services
  • Data commercialization agreements (earth observation, navigation, meteorology)
  • Joint ventures and strategic alliances for New Space projects
  • Space technology licensing and transfer
  • Aerospace manufacturing contracts and multi-jurisdictional supply chain

Space systems generate, transmit and depend on data at every level. HEKA’s integrated approach, combining space law with our consolidated data protection and cybersecurity practice, offers a unique competitive advantage.

  • IP protection in space technology (patents, trade secrets, know-how)
  • Earth observation and in-orbit data regulation
  • Privacy and data protection in satellite systems
  • Cybersecurity of critical space infrastructure
  • Liability for damage caused by space objects

An integrated team
with multiple
specialties.

Our New Space Law practice does not rely on a single specialist. We operate as an integrated task force, combining key capabilities in:

Space Regulatory

We design and implement regulatory strategies for space operations, integrating licensing, compliance and international standards in evolving normative environments.

PPP & State Contracts

We structure public-private partnerships and state contracts for the development of space infrastructure and projects, aligning public interest, investment and efficient execution.

FDI (Foreign Direct Investment)

We advise on the structuring and channeling of foreign investment into space projects, facilitating capital entry into emerging markets under complex regulatory frameworks.

Corporate & M&A

We structure and scale corporate vehicles for space projects, aligning investment, risk management and compliance in highly complex regulatory environments.

International Tax

We design tax planning strategies for space operations, integrating fiscal efficiency, compliance and risk management in sophisticated cross-border structures.

Cross-Border Structuring

We develop legal architectures for international operations, optimizing corporate structures and investment flows across multiple jurisdictions.

Commercial & Transactional

We structure and negotiate complex agreements throughout the space value chain, from technology development to the provision of specialized services.

Intellectual Property (IP)

We protect and manage intangible assets in space technology, ensuring their valuation, commercial exploitation and defense at global scale.

Data Protection

We design data protection frameworks for space operations, aligned to international standards and cross-border transfer dynamics.

Cybersecurity

We develop legal strategies for the management of cyber risks in critical space infrastructures, strengthening resilience and compliance.

Environmental

We advise on environmental compliance for space projects, integrating sustainability, international standards and impact management in new infrastructures.

International Arbitration

We represent clients in complex space sector disputes, with a focus on international arbitration and strategic resolution of high-exposure conflicts.

Why Ecuador.
Why now.

Equatorial Advantage

Ecuador’s location at zero degrees latitude offers a unique geophysical advantage in the region: direct orbital launch trajectories, lower fuel consumption and greater payload capacity per mission.

2030

First Spaceport

Ecuador projects the construction of its first spaceport by 2030, which will require a complete regulatory framework that does not yet exist. The legal architecture must be built from scratch.

No Space Law. Yet.

Ecuador does not have a national space law. The regulatory framework that will govern the space economy is being written now. Those who participate first in its design will have a lasting competitive advantage.
